Choice A, where the government moves to dismiss by saying that all the acts at issue were official acts, isn't so bad for the government. They won't need to concede that the acts were fraudulent and murderous. For example, even the totally fraudulent COVID death totals won't give one much purchase. The government's answer will just be, "Yes, we published those numbers, which by the way are confirmed by numerous reports around the world blah blah. We move to dismiss that these were official acts."
And once the claim is dismissed, there's no way to find out, at least through that case, whether the COVID death totals were fraudulent or murderous. Of course, the numbers are totally fraudulent, because the virus is as fake as the PCR test and the whole scamdemic. But that's another story.
There is a fourth option of We the People deposing the tyranny, but of course that requires the people to recognize the tyranny and their constrained options for legal recourse. The Five Stones approach is an important stepping stone to The People realizing the truth.

At some point I read that once a public health emergency was in place, executive power/authority transferred from the President to the DHHS (Azar). If this is true, would not the subsequent actions remove Trump/Biden from liability?
As an aside, it seems to me that most of our current problems stem from emergency powers, coupled with the effective nullification of Smith-Mundt. How much of the current situation would improve with the end of emergency powers and putting an end to government propaganda?
I think Trump and Biden retain liability as supervising officials that participate in the de facto but unlawful transfer of power.
I agree that ending the emergency powers and government propaganda powers would go a long way to resolving the structural problems with the separation of powers between the three federal branches and the federal and state governments.
I no longer believe that any of our problems can be solved within the confines of the Constitution and our current legal framework, especially given how corrupt the judiciary clearly is. All government machinations have become extra- or pseudo-legal, have unlimited funding and cover, and operate with the goal to circumvent or negate our God Given Rights. In other words, all avenues for redress of grievances are now forbidden by same government. What happens when government attacks its own citizenry? It seems to me that the solutions, if there are to be any, must be equally unorthodox and external.
