I don't think his approach has high odds of success, but I always say -- and still believe -- that every type of legal case people want to try filing, they should try filing, because it all goes to the overall attrition process (getting the judges to switch sides and start upholding Constitution) and public education/political process.
Attorney Todd Callender filed a case based largely on 10 USC 1107a in August 2021. Robert v. Austin.
Last I checked on it, 10th Cir. oral arguments were held Nov. 16, 2022.
DoD/DOJ trying to get it dismissed on grounds that the two named plaintiffs are being cycled out of military on non-Covid bases (retirement, etc.) so case is moot.

It does matter. Here and now is not the first time and place a government has been at war with its own people, covertly or overtly.
It's always been worth fighting back and it still is.

I have corresponded with Ward a little bit. I don't think his approach has high odds of success, but I always say -- and still believe -- that every type of legal case people want to try filing, they should try filing, because it all goes to the overall attrition process (getting the judges to switch sides and start upholding Constitution) and public education/political process.

DoD/DOJ trying to get it dismissed on grounds that the two named plaintiffs are being cycled out of military on non-Covid bases (retirement, etc.) so case is moot.
Dr. Sam Sigoloff is a plaintiff on another, similar case, called Coker v. Austin.

Very interesting analysis. I really like to hear more about how the Civil War figures into this with some specifics (I've noted Charles A. Beard's telling of the special interest involved in the creation of the US Constitution). Howard Zinn first alerted me to the people's history of the Civil War and the various rebellions that precipitated the creation of an elite establishment, their capital and US Constitution (contract of concentrated rule). Thomas DiLorenzo's The Real Lincoln provides an unvarnished perspective of that war and Lincoln's role. Zinn an anti-war progressive and DiLorenzo, a libertarian readily join this fray in a time when such was not outright woke "banned".
